Marc Benjoya and Sally Zimmerman Receive Favorable Verdict in Obstetrics Malpractice Case

In this case, Cassiday Schade Partner Mark Benjoya defended an OB/GYN accused of failing to properly interpret fetal monitor strip abnormalities which reflected lack of fetal reserve and fetal distress during labor.  Plaintiff alleged that the failure to intervene and order an emergency cesarean section in a timely fashion resulted in the baby being born severely depressed and compromised resulting in the death of the baby the day following delivery.  Plaintiff claimed that the death resulted in her own emotional distress and loss of society and that the estate incurred medical expenses and funeral expenses. The defense contended that the labor of this primigravida with the fetus in occiput posterior position failed to progress in labor despite administration of Oxytocin.  The defendant contended that she had recommended a C-section on three occasions to the patient, all of which were refused.  None of the recommendations were charted by the defendant and the plaintiff denied any such recommendations.  The patient finally consented and 10 minutes later the fetus’ heart rate became severely bradycardic and an emergency C-section was carried out.  The defense contended that a sudden, unpredictable placental abruption occurred contemporaneously with the baby crashing which caused the baby’s condition at birth and the death of the baby.  The defense presented testimony from experts in the fields of obstetrics, placental pathology and neonatology. Damages in the amount of $525,000 were asked of the jury. A verdict of not guilty was returned.
