Construction

The representation of contractors, developers and design professionals has been a focus of Cassiday Schade LLP since the inception of the firm over 30 years ago. The depth of our experience covers the broad spectrum of all points where construction and the law intersect. Our list of clients includes the largest general contractors in Illinois as well as owners, architects, engineers and specialty subcontractors. We routinely represent these companies in their biggest and most problematic cases. While we have the ability to staff large accounts, we keep our client teams small so that our attorneys remain familiar with the client’s background and needs. This ensures efficiency and consistency in our representation of our clients.

In the litigation arena, our Construction Practice Group has handled a wide array of construction-related disputes. In the tort field, this includes lawsuits for personal injury, wrongful death, construction defect and property damage. On the commercial side, we have represented parties in disputes based on delay, non-conforming work, breach of contract and mechanic’s liens. We also represent clients on OSHA citations issued and prosecuted by the United States Department of Labor.

The outcome of many litigated disputes often turns on the resolution of insurance and indemnification issues. Few law firms can match our experience in analyzing and resolving these issues. Our lawyers are in demand for their ability to navigate these areas of complexity.

We also counsel our clients with respect to risk avoidance and risk transfer. We have drafted contract agreements, safety manuals and the like in order to insulate our clients from liability. We have worked with many clients in perfecting the language in their contract agreements with respect to additional insured requirements. We have also worked directly with our clients’ insurers and their insurance brokers to make sure that our clients are afforded the maximum protection in the wording of insurance policies. When our clients’ requirements on additional insured coverage are not met, we know exactly what needs to be done both inside the courtroom and out of it.
