Commercial Litigation

Our experience in business litigation includes the representation of banks, investment firms, real estate financing and investment firms, hospitals, corporations, partnerships, and not-for profit companies and organizations. We have been retained in matters ranging from breach of contract, business torts, UCC matters, unfair competition, foreclosure, retaliatory discharge, fraud and insurance disputes. 

Our firm has tried hundreds of cases to verdict with excellent results in both federal and state courts and is known as one of the leading trial firms in the Midwest.  Our experience includes representing clients in complex litigation, class actions, multi-jurisdiction litigation and before administrative agencies.  

We recognize that trial is only one tool available to our clients and focus on creating solutions for problems that are effective both in achieving the right result and making sense economically.  We employ pre-litigation strategies to try to resolve disputes quickly, and we regularly use mediation and arbitration to achieve the desired result.  When litigation is necessary, we have on many occasions successfully developed, prepared and prevailed on dispositive motions to shorten the litigation process.

However, even in those settings, it is important to let the other parties know that you are prepared to litigate the matter to trial and verdict if necessary to achieve an equitable result.  Having lawyers that are recognized as knowing how to successfully try a case is essential in communicating that message.  Our experience separates us from many other firms that litigate cases with little or no reputation in the courthouse.

We also consult with clients to provide litigation avoidance strategies to best protect their interests and to lessen, if not prevent, exposure to unnecessary business problems before they occur.  When such threats cannot be eliminated, we focus on putting our clients in the best possible position to prevail in any potential dispute.
